Terms & Conditions
“Carer” means the person who attends the class with the Child and who is responsible for looking after him/her.
“Class” means a Mini Athletics Class as described on the Mini Athletics website.
“Competitor” means any person or entity which competes with Mini Athletics Ltd or offers classes similar to those offered by Mini Athletics Ltd
“Fees” means the membership fee and the price charged for attending Classes.
“Medical condition” means any contagious or infectious disease or other issue which affects a Mini Athlete, Parent or Carer, including any behavioural disorder.
“Child” means any child who attends a Mini Athletics Class.
“Mini Athletics” means Mini Athletics Ltd and associated franchisees.
“Parent” means the Parent or Legal Guardian of any Child.
“Premises” means any premises where Mini Athletics classes are conducted.
“Terms and Conditions” means the Terms and Conditions set out in this document, save where amendments are agreed in writing between Mini Athletics Ltd and a Parent.
“Website” means the website at www.miniathletics.com
a) These Terms and Conditions shall be deemed to be accepted by the Parent and the Carer once they have ticked the box confirming acceptance on the online booking form and confirmation of payment of fees has been received by Mini Athletics.
b) No variation to the Terms and Conditions shall be binding unless it is agreed in writing between Mini Athletics and the parent of the relevant Child.
c) Mini Athletics shall have absolute discretion to cancel its contract with any Parent for any reason. Mini Athletics will accept no responsibility for loss or damage arising from such cancellation but will refund fees for any Classes not taken by reason of its cancellation of a contract.
d) Mini Athletics reserves the right to change coaching staff at its absolute discretion.
3. Fees and Payment
a) The Parent shall pay all Fees due for a term or block of either 6 or 12 Classes when completing the online booking form and before the Child participates in any of the Classes for which the Fees are payable.
b) The Classes paid for must be taken weekly in succession as they fall due.
c) Fees are not refundable for any Classes missed.
d) Mini Athletics will only refund fees in the circumstances set out at Clause 2c of these Terms and Conditions.
3. Class Bookings and Classes
a) The Parent warrants that the information provided on the online booking form is accurate and up to date at the time of booking and that it will notify Mini Athletics of any changes immediately.
b) The Parent or Carer must inform Mini Athletics of any Medical Condition affecting a Child before the Child participates in any Class.
c) Neither the Child, or his or her Parent or Carer, must attend a Mini Athletics Class when suffering from any Medical Condition without first notifying Mini Athletics and obtaining its consent to the Child participating in the Class.
d) The Parent and Carer shall have sole responsibility for the conduct and care of the Child during any class or whilst the Child is on the Premises.
e) The Parent or Carer shall not leave the Child unattended for any period of time whilst the Child is on the Premises.
f) Mini Athletics shall have absolute discretion to exclude a Child, Parent or Carer from any Class or Classes if, in the opinion of Mini Athletics, this is necessary to ensure the safety and wellbeing of other Children, Parents or Carers.
By agreeing to these Terms and Conditions, Parents and Carers agree that:
a) They will not share any aspect of the Mini Athletics programme with any Competitor of Mini Athletics;
b) They will not replicate or use any material provided by Mini Athletics or provide such material for the use of any third party; and
c) They are not and will not become involved in any Competitor of Mini Athletics.
5. Exclusion from Liability
a) Subject to clause 6d below, Mini Athletics accept no responsibility under any circumstances for any loss suffered by the Parent, the Carer or by any other party arising either directly or indirectly from the Child’s participation in a Class or from any act or omission on the part of its coaching staff, whether or not such act or omission is negligent.
b) The Parent agrees, both on his/her own behalf and that of the Child, that any claim against Mini Athletics must be brought within 60 days of the event which gave rise to the claim. Any claim made thereafter will be time-barred.
c) The Parent agrees that the maximum liability Mini Athletics shall bear either to the Parent or to the Child for any breach of these Terms and Conditions shall not exceed the Fees.
d) Nothing in these Terms and Conditions shall restrict or exclude liability for death or personal injury caused by the negligence of Mini Athletics or by any of its coaching staff.
a) By agreeing to these Terms and Conditions, the Parent consents to the processing and use of personal data relating to the Child and the Parent by Mini Athletics.
b) The parent shall indemnify Mini Athletics for all losses sustained as a consequence of any act or omission on the part of a Child, parent or Carer.
c) Any notices to be sent to any party to this contract shall be sent by pre-paid recorded delivery or hand-delivered and shall be deemed to have been received by the addressee within 48 hours of posting or immediately if hand delivered.
d) Any failure by a party to the contract governed by these Terms and Conditions to enforce for any period of time rights arising under the contract shall not operate as a waiver of those rights.
e) This contract shall be governed by the laws of England and Wales.
